Kreiranjem računa ili naručivanjem putem QRForgea pristajete na ove Uvjete korištenja. Ako se ne slažete, ne koristite platformu. Ovi Uvjeti čine pravno obavezujući sporazum između vas i OD "DataPoint" vl. Hodzic Nermin, Milerova 2L, 75300 Lukavac, Bosna i Hercegovina ("QRForge", "mi", "nas").

By creating an account or placing an order through QRForge, you agree to these Terms of Service. If you do not agree, do not use the platform. These Terms constitute a legally binding agreement between you and OD "DataPoint" vl. Hodzic Nermin, Milerova 2L, 75300 Lukavac, Bosnia and Herzegovina ("QRForge", "we", "us").

Možemo ažurirati ove Uvjete. Nastavak korištenja nakon objave izmjena znači da prihvatate izmijenjene Uvjete.

We may update these Terms. Continued use after changes are posted means you accept the revised Terms.

2. Usluga

QRForge je online platforma. Restorani je koriste da prikažu svoj meni i primaju narudžbe za dostavu preko vlastitog QR koda ili linka. Nezavisne dostavne službe je koriste da te narudžbe dostave svojim kuririma.

QRForge is an online platform. Restaurants use it to show their menu and take delivery orders through their own QR code or link. Independent delivery services use it to deliver those orders with their own couriers.

• QRForge upravlja platformom: stranicama menija i narudžbe, potvrdom broja telefona, prosljeđivanjem narudžbe restoranu i dostavnoj službi te praćenjem narudžbe. QRForge ne prodaje hranu, ne priprema je i ne zapošljava kurire.
• Restoran vam prodaje hranu. On određuje meni, cijene i informacije o alergenima, priprema narudžbu i odgovoran je za hranu.
• Dostavna služba (firma ili obrt u partnerstvu s restoranom) dostavlja narudžbu svojim kuririma i određuje cijenu dostave za vaše područje. Kuriri rade za dostavnu službu, ne za QRForge.

• QRForge runs the platform: the menu and order pages, phone verification, passing your order to the restaurant and the delivery service, and order tracking. QRForge does not sell food, does not prepare it and does not employ the couriers.
• The restaurant sells you the food. It sets the menu, prices and allergen information, prepares the order and is responsible for the food.
• The delivery service (a business or sole trader, "obrt", partnered with the restaurant) delivers the order with its own couriers. It sets the delivery fee for your area. Couriers work for the delivery service, not for QRForge.

Platforma se pruža „kakva jest" i „prema raspoloživosti". Ne garantujemo neprekidan pristup. Funkcije možemo mijenjati ili ukinuti uz razumno obavještenje.

The platform is provided "as is" and "as available". We do not guarantee uninterrupted access. We may change or discontinue features with reasonable notice.

3. Vaš račun

3. Your Account

Morate imati najmanje 18 godina da biste koristili QRForge ili naručili. Odgovorni ste za čuvanje povjerljivosti podataka za prijavu i za sve aktivnosti na računu. Odmah nas obavijestite na support@qrforge.link ako sumnjate na neovlašteni pristup.

You must be at least 18 years old to use QRForge or place an order. You are responsible for keeping your sign-in details confidential and for all activity under your account. Notify us immediately at support@qrforge.link if you suspect unauthorised access.

Zadržavamo pravo suspenzije ili ukidanja računa koji krše ove Uvjete, uključuju se u prijevarne aktivnosti ili su neaktivni više od 24 mjeseca.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 24 months.

4. Broj telefona

Za narudžbu dostave morate unijeti broj mobilnog telefona i potvrditi ga jednokratnim kodom koji šaljemo SMS-om. Taj kod za prijavu je jedini SMS koji vam QRForge šalje. Promjene statusa narudžbe vidite na stranici za praćenje narudžbe i, ako to dozvolite, kao obavještenja u pregledniku.

To place a delivery order you must give a mobile phone number and confirm it with a one-time code we send by SMS. This sign-in code is the only SMS QRForge sends you. Order updates appear on the order tracking page and, if you allow it, as browser notifications.

Vaš broj telefona dijelimo samo s restoranom i dostavnom službom/kurirom koji obrađuju vašu narudžbu, kako bi vas mogli kontaktirati u vezi s tom narudžbom. Ne koristimo ga za marketing.

Your phone number is shared only with the restaurant and the delivery service/courier handling your order, so they can reach you about that order. We do not use it for marketing.

Kada naručite, ugovor za hranu sklapate s restoranom, koji je prodavac. Dostavu obavlja dostavna služba. QRForge je samo posrednik koji pruža platformu i nije strana u prodaji hrane.

When you order, your contract for the food is with the restaurant, which is the seller. The delivery is performed by the delivery service. QRForge acts only as an intermediary that provides the platform. It is not a party to the sale of the food.

5.2 Naručivanje

Birate jela iz menija restorana, unosite ime, adresu dostave i napomene te potvrđujete broj telefona. Ako dodirnete „koristi moju lokaciju", dodaje se lokacija vašeg uređaja kako bi vas kurir lakše pronašao. Prije slanja narudžbe vidite stavke, cijenu dostave i ukupan iznos za plaćanje. Narudžba je potvrđena tek kada je stranica za praćenje prikaže kao prihvaćenu. Restoran može odbiti narudžbu, npr. ako ne radi, ako je preopterećen ili ako neko jelo nije dostupno.

You choose dishes from the restaurant's menu, enter your name, delivery address and any notes, and confirm your phone number. If you tap "use my location", your device's location is added to help the courier find you. Before you send the order you see the items, the delivery fee and the total to pay. Your order is confirmed only when the tracking page shows it as accepted. A restaurant may decline an order, for example if it is closed, busy or an item is unavailable.

Cijene su prikazane u KM onako kako ih je odredio restoran. Cijenu dostave za vašu zonu određuje dostavna služba. Obje vidite prije narudžbe. Može važiti minimalni iznos narudžbe, koji je prikazan prije narudžbe. QRForge vam ne naplaćuje nikakvu vlastitu naknadu. Restoran je odgovoran za svaki propisani račun.

Prices are shown in KM as set by the restaurant. The delivery service sets the delivery fee for your delivery zone. You see both before you order. A minimum order value may apply; it is shown before you order. QRForge charges you no fee of its own. The restaurant is responsible for any required receipt.

• Vi: narudžbu možete otkazati na stranici za praćenje dok je otkazivanje još moguće, tj. dok je restoran nije prihvatio i počeo pripremati. Nakon toga se obratite restoranu (broj telefona je na stranici za praćenje).
• Restoran ili dostavna služba: mogu odbiti ili otkazati narudžbu i moraju navesti razlog. Razlog vidite na stranici za praćenje.
• Automatski: narudžba se automatski otkazuje ako nema dostupnog kurira ili ako restoran ne odgovori na vrijeme.

• By you: you can cancel on the tracking page while the order can still be cancelled, which means until the restaurant has accepted it and started preparing it. After that, contact the restaurant (its phone number is on the tracking page).
• By the restaurant or the delivery service: they may reject or cancel an order and must give a reason. You will see the reason on the tracking page.
• Automatically: an order is cancelled automatically if no courier is available or the restaurant does not respond in time.

Pošto plaćate tek pri preuzimanju, otkazana narudžba vas ništa ne košta.

As you pay only on delivery, a cancelled order costs you nothing.

Kurir donosi narudžbu na adresu koju ste unijeli. Prikazana vremena dostave su procjena. Provjerite da su adresa i broj telefona tačni i budite dostupni. Restoran ili dostavna služba mogu otkazati narudžbu koju ne mogu predati.

The courier brings the order to the address you entered. Delivery times shown are estimates. Please make sure the address and phone number are correct, and please be reachable. The restaurant or delivery service may cancel an order it cannot hand over.

5.7 Alergeni i informacije o hrani

Za opise jela, sastojke i informacije o alergenima, kao i za hranu koju priprema, odgovoran je restoran. Ako imate alergiju ili netoleranciju, navedite to u napomeni narudžbe i nazovite restoran prije narudžbe ako niste sigurni. QRForge prosljeđuje vašu napomenu, ali ne može provjeriti niti garantovati sastojke.

The restaurant is responsible for its menu descriptions, ingredients and allergen information, and for the food it prepares. If you have an allergy or intolerance, tell the restaurant in the order note and call the restaurant before ordering if you are unsure. QRForge passes your note on but cannot check or guarantee ingredients.

5.8 Problemi i prigovori

5.8 Problems and complaints

Za problem s hranom (stavka nedostaje, pogrešno jelo, kvalitet) prvo se obratite restoranu. Njegov broj telefona je na stranici za praćenje. Ako se problem ne riješi, ili za probleme s dostavom ili platformom, pišite na support@qrforge.link i navedite kod narudžbe. Prigovor ćemo proslijediti odgovarajućem partneru i pomoći u dobroj vjeri. Vaša zakonska prava potrošača ostaju nepromijenjena.

For a problem with the food (missing item, wrong dish, quality), contact the restaurant first. Its phone number is on the tracking page. If that does not resolve it, or for problems with the delivery or the platform, write to support@qrforge.link with your order code. We will pass your complaint to the right partner and help in good faith. Your statutory consumer rights are not affected.

5.9 Odgovornost

5.9 Liability

Restoran je odgovoran za hranu, a dostavna služba za dostavu. QRForge je odgovoran da platformom upravlja s dužnom pažnjom. Nije odgovoran za hranu, njenu pripremu, alergene, temperaturu ili kvalitet, niti za ponašanje kurira. U mjeri u kojoj zakon dozvoljava, QRForge ne odgovara za indirektnu ili posljedičnu štetu. Ništa u ovim Uvjetima ne ograničava odgovornost koja se po zakonu ne može ograničiti, uključujući namjeru i krajnju nepažnju.

The restaurant is responsible for the food, and the delivery service for the delivery. QRForge is responsible for running the platform with reasonable care. It is not responsible for the food, its preparation, allergen content, temperature or quality, or for the courier's conduct. To the extent permitted by law, QRForge is not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law, including for intent or gross negligence.

6. Restorani i dostavne službe (partneri)

6. Restaurants and delivery services (partners)

• Krediti. Partneri koriste platformu uz unaprijed plaćene kredite za dostavu, kupljene kao jednokratni paketi preko našeg pružaoca plaćanja LemonSqueezy. Za svaku isporučenu narudžbu skida se 1 kredit restoranu i 1 kredit dostavnoj službi. Otkazane narudžbe ne troše kredite. Bez kredita su nove narudžbe za dostavu pauzirane dok ne dopunite kredite. Krediti se ne vraćaju i nemaju rok trajanja; vidi Politiku povrata.
• Kuriri. Dostavna služba sama angažuje i plaća svoje kurire, izvan platforme. QRForge im nije poslodavac i ne isplaćuje ih.
• Zaštita podataka. Partneri primaju lične podatke kupaca samo radi izvršenja narudžbi. Ugovor o obradi podataka za restorane i Ugovor o obradi podataka za dostavne službe sastavni su dio ovih Uvjeta za partnere.
• Hrana i propisi. Restorani su odgovorni za sigurnost hrane, informacije o alergenima, cijene, propisane račune i vlastite dozvole. Dostavne službe su odgovorne za svoje kurire i vlastite dozvole.

• Credits. Partners use the platform with prepaid delivery credits, bought as one-time packs through our payment provider LemonSqueezy. For each delivered order, 1 credit is deducted from the restaurant and 1 credit from the delivery service. Cancelled orders use no credits. With no credits left, new delivery orders are paused until you top up. Credits are non-refundable and do not expire; see the Refund Policy.
• Couriers. A delivery service engages and pays its couriers itself, outside the platform. QRForge is not their employer and does not pay them.
• Data protection. Partners receive customers' personal data only to fulfil orders. The Restaurant DPA and the Delivery service DPA form part of these Terms for partners.
• Food and legal compliance. Restaurants are responsible for food safety, allergen information, prices, any required receipts and their own licences. Delivery services are responsible for their couriers and their own licences.

7. Prihvatljivo korištenje

7. Acceptable Use

Slažete se da nećete koristiti platformu u prijevarne ili nezakonite svrhe, postavljati lažne narudžbe, obavljati obrnuto inženjerstvo, kreirati više računa radi zaobilaženja ograničenja, niti uznemiravati kurire, osoblje restorana ili zaposlenike QRForgea. Kršenja mogu dovesti do suspenzije računa ili ograničenja naručivanja. Možemo ograničiti naručivanje za brojeve telefona s ponovljenim otkazivanjima ili narudžbama koje nisu preuzete.

You agree not to use the platform for fraudulent or unlawful purposes, place false orders, reverse-engineer or scrape the platform, create multiple accounts to circumvent restrictions, or harass couriers, restaurant staff, or QRForge employees. Violations may lead to suspension of your account or restrictions on ordering. We may restrict ordering for phone numbers with repeated cancellations or orders that were not accepted at the door.

8. Intelektualno vlasništvo

8. Intellectual Property

Svi zaštitni znakovi, logotipi, softver i sadržaj na QRForgeu su vlasništvo OD "DataPoint" vl. Hodzic Nermin ili njegovih davatelja licence. Primate ograničenu, neisključivu, neprenosivu licencu za korištenje platforme samo u predviđene svrhe.

All trademarks, logos, software, and content on QRForge are the property of OD "DataPoint" vl. Hodzic Nermin or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose only.

9. Mjerodavno pravo i sporovi

9. Governing Law & Disputes

Na ove Uvjete primjenjuje se pravo Bosne i Hercegovine. Svaki spor prvo nastojimo riješiti sporazumno. Ako se ne riješi u roku od 30 dana, nadležan je sud prema sjedištu operatera. Ako ste potrošač, zadržavate zaštitu prema prinudnim propisima o zaštiti potrošača; vaša zakonska prava potrošača ostaju nepromijenjena.

These Terms are governed by the laws of Bosnia and Herzegovina. We will first try to resolve any dispute amicably. If it is not resolved within 30 days, the competent court at the operator's seat has jurisdiction. If you are a consumer, you keep the protection of the mandatory consumer-protection rules; your statutory consumer rights are not affected.
